Timber Apps, LLC provides this statement explaining our online information practices and the way in which your personal information is collected and used (“Privacy Policy”). By visiting gettract.com (the “Site”) and using its services (the “Services”), you, the Consumer (“User”) consent to the practices described in this statement. If you do not agree with the practices explained in this policy, do not access or browse the Site or use the Service.
COLLECTION OF PERSONAL INFORMATION
Timber Apps may request information about Users through the Services, including: (1) e-mail address, (2) first and last or business name, (3) country or region, (4) state or territory, (5) ZIP code or postal code, (6) gender, or (7) birth date/age (together “ Personally Identifiable Information”). Timber Apps may also collect and store the Internet Protocol address (“IP address”) of a User’s mobile device or computer, which may be needed to operate various features of the Services or to determine any misuse of content. We may also collect data pertaining to a User’s online transactions, purchase and sale history, and Services usage patterns, as well as pricing and location for timber loads entered into the App (together “Transaction Information”).
Timber Apps owns all of the data created by Users through use the Services.
USE OF PERSONAL INFORMATION
Timber Apps will not sell, rent, or share Users’ Personally Identifiable Information with others without User consent, except as provided: (a) to deliver the Services and send notices related to the Services, User accounts, and necessary updates; (b) to manage accounts and to keep track of support and customer service requests; and (c) to aggregate User with that of other Users, without individually identifying a User, for marketing, promotional and informational purposes, as listed below.
While delivering the Services, we may recommend to Users various content, products, and services. Accordingly, we may analyze data pertaining to the Users’ Transaction Information so that we can make recommendations suited especially to the User.
Timber Apps may use information we collect from and about you to:
· Deliver the products and services that you have requested;
· Manage your account and provide you with customer support;
· Perform research and analysis about your use of or interest in our products, services and content or the products, services and content offered by others;
· Communicate with you by e-mail, postal mail, telephone and/or mobile devices or send newsletters about products or services that may be of interest to you either from us or third parties;
· Communicate with you with regard to partially completed service requests;
· Develop and display content and advertising tailored to your interests on our app or site;
· Verify your eligibility and deliver offers in connection with promotions;
· Perform reviews, which may include the use of third parties, of timber professionals’ credentials;
· Perform anonymous, secure and private aggregation of timber prices;
· Enforce our Terms of Use and other conditions of use of our Services;
· Publicly display comments, ratings and reviews and other content provided by Users;
· Manage our business; and
· Perform functions as otherwise described to you at the time of collection.
GENERAL DISCLOSURE OF PERSONAL INFORMATION
Timber Apps occasionally hires other companies to provide limited tasks on Timber Apps’s behalf, such as customer support, resolving problems in the Services, communicating with Users about the Services, and providing Users advertising and promotional information in connection with the Services. Timber Apps will only provide these companies with those pieces of Personally Identifiable Information needed to complete the tasks, and the companies and their employees are prohibited from using that Personally Identifiable Information for any other purpose. Timber Apps may share Personally Identifiable Information with third parties in order to fulfill a service or transaction a User requests.
Timber Apps may disclose Personally Identifiable Information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on Timber Apps; (b) protect and defend the rights or property of Timber Apps and of the content as licensed to Timber Apps; or (c) act under exigent circumstances to protect the personal safety of Users or the public. If Timber Apps files for bankruptcy, or there is a transfer of the assets or ownership, Timber Apps assumes no obligation to inform Users that information has been provided to third parties.
MANAGING PERSONAL INFORMATION
Users can always add, update, or remove information in their user profile. In addition, Users can change their preferences for contact with Timber Apps.
PUBLIC INFORMATION
Any information that Users reveal in their user profile, in communication with any other Users, or in other online discussions or forums (all “ Profile Information”), is intentionally open to the public and is not in any way private. Think carefully before publicly disclosing any Personally Identifiable Information. Profile Information may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.
SECURITY AND STORAGE OF YOUR PERSONAL INFORMATION
Timber Apps uses reasonable precautions to keep User information, including timber pricing, secure. We employ a variety of security technologies and procedures to help protect Personally Identifiable Information from unauthorized access, use, or disclosure. However, due to the open nature of communication through the Internet, we cannot guarantee that communications between Users and the Services will be free from unauthorized access by third parties.
OPERATIONAL INFORMATION
Some operational information (“Operational Information”) is used by the Services in order to operate accounts properly and provide the services requested. This Operational Information does not include Personally Identifiable Information, but may include the date on which a profile was last updated, whether an e-mail address has been verified, whether an account has been deactivated, a specific browser used, and an IP address of a computer or networking device. Operational Information may be shared with third parties to the extent necessary to provide the Services.
AGGREGATE INFORMATION
We may collect and analyze information about Users of the Services in the aggregate (“Aggregate Information”), for example: overall usage patterns of Users; total number of Users; percentage of Users who are female, or in a certain age range, or who live in a particular region; or the percentage of Users who are also purchasers of various other products and services. The collection and analysis of Aggregate Information is important in the operation and enhancement of the Services and other business purposes. Aggregate Information may be compiled in reports and disclosed, sold, licensed or rented to third parties. However, since Aggregate Information does not include any information that can be used to individually identify a User, the third party recipient of the Aggregate Information cannot use it to contact a User.
Aggregated timber pricing data will be shared with Timber Update and possibly other third parties for informational purposes only. The information will be aggregated before sharing so that it will not include any identifiable information as to source or provider. Users are assured that their individual pricing information is as secure as all user provided information.
USE OF COOKIES
A cookie is a very small text file that a website saves to a computer’s hard disk to store information that Users provide, including their preferences.
Timber Apps may place Internet cookies on your hard disk to store User profile information. The cookie allows Users to move from page to page at the Site without having to sign in again on each page.
Users may have the ability to accept or decline cookies in the settings on their browser. However, if Users choose to decline cookies, Users may not be able to sign in or use the Services.
THIRD-PARTY WEBSITES
Third party websites and services accessible through the Site have separate privacy and data collection practices, independent of Timber Apps. Timber Apps has no responsibility or liability for these independent policies or actions. If Users provide any information to such third parties, different rules regarding the collection and use of personal information may apply. We strongly suggest that Users review such third parties’ privacy policies before providing any data to them.
REASONABLE EFFORTS
We will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when we learn of any failure to comply with this Privacy Policy or as required by Georgia Code §10-1-912 “Notification required upon breach of security regarding personal information.” We sometimes release beta versions of our products and services, which are further refined before the release of the final version. Because these products and services are still in a test phase, we may not always discover an unintended privacy issue, despite our best efforts to do so. As such, we welcome User feedback on any privacy concerns. In light of the above and because of the complex and constantly changing nature of our technology and business, and the security risks associated with using the Internet, we do not guarantee error-free performance under this Privacy Policy. To the extent permissible under law, Timber Apps is not liable for any incidental, consequential, or punitive damages relating to this privacy policy, including for any security breach that compromises any User’s Personally Identifiable Information as it relates to Timber Apps’s website, servers, or software.
CHANGES TO THIS PRIVACY POLICY
Timber Apps reserves the right to modify its Privacy Policy at any time. When we do so, we will also revise the “last updated” date at the bottom of the Privacy Policy. We encourage Users to frequently review the Privacy Policy for any modifications.
